        "Food safety law" the ninety-ninth will be "foodborne disease" is defined as "foodborne diseases, pathogenic factors in the food into the human body caused by diseases such as infectious, toxic". Therefore, food safety accident may cause the occurrence of foodborne illness. 
 
        According to the regulation of food safety related laws and regulations, health department of family planning in the aspect of foodborne disease bear the main responsibilities are: one is the state set up a food safety risk monitoring system, monitoring of foodborne disease, by the national health and family planning commission and the provincial family planning administrative department of health is responsible for the state monitoring and local monitoring plan; 2 it is found that the patients receiving medical institutions belong to food-borne diseases, food poisoning patients, or suspected foodborne disease patients, suspected food poisoning patients, should report to the family planning administrative department of public health jurisdiction; 3 it is the family planning administrative department of public health at all levels shall report to the analysis of foodborne disease information verification; Four is to the family planning administrative department of public health departments at all levels on the food safety of foodborne disease surveillance found hidden danger; Five is the organization for disease control and family planning administrative department of public health agencies at all levels in accordance with the law to carry out the food safety accident epidemiological investigation; Six is the family planning administrative department of public health to carry out the prevention of foodborne disease early warning work. 
 
        Second, in the background 
 
        In 2012, the state council issued "decision on strengthening the work of food safety" (guo fa [2012] no. 20, hereinafter referred to as the "decision") and the national food safety regulatory system "twelfth five-year" plan "(guo fa [2012] no. 36, hereinafter referred to as the" planning "), the foodborne disease surveillance as an important job content, requirements and establish and improve the foodborne disease surveillance network reporting system, focus on strengthening trend of foodborne disease and the cause analysis and improve the ability of find food safety of systemic risk. Committee leadership attaches great importance to the food-borne disease monitoring and management, multiple instructions require further strengthen foodborne disease surveillance. 
 
        In order to strengthen the foodborne disease related work, by commission in 2012 issued the notice on further strengthening of foodborne disease related work (who supervise is sent [2012] 2012), 2013 issued "about further notice for food safety related work (who family planning is sent [2013] no. 25) and the notice on further strengthening the food safety risk monitoring" (the health food is sent [2013] no. 6). In order to further implement the food safety law and its implementing regulations, implement the "decision" and "the plan" work deployment, well implement the family planning departments for public health in food-borne diseases related functions, rationalize foodborne diseases, monitoring, information and verify the report, early warning, treatment and emergency management mechanism, to better fulfill the legal responsibility, it is necessary to formulate the measures for the management of foodborne disease (hereinafter referred to as the "method"). 
 
        Third, formulate principles and goals 
 
        Around the food safety law and related laws and regulations, combined by the job functions and foodborne disease prevention and control of food safety related work, fully draw lessons from international advanced experience, earnestly implement the food-borne disease monitoring, reporting, investigation and information management responsibilities, clear foodborne disease management workflow, play to relevant institutions in the treatment, prevention and control of foodborne diseases. In the process of drafting, according to the needs of the responsibilities and tasks, reasonable division of national health and family planning commission, the Chinese center for disease control and prevention, national center for food safety risk assessment of responsibilities, and implement the local family planning administrative department of public health, disease prevention and control institutions and medical institutions the responsibility of the task. 
 
        Give full consideration to the methods, and the law on the prevention and control of infectious diseases, the emergent public health event emergency ordinance, "the national food safety accident emergency plan" and other laws and regulations of food poisoning and food-borne disease and public health emergencies related role and cohesion, at the same time with the food safety office is under the state council of the food safety accident investigation and handling measures of cohesion. 
 
        Fourth, develop process

        In 2013 April, may and July, food department held three times "method" for seminars, inviting committee, legal department, emergency department, medical administration hospital authority, CDC bureau and some local family planning administrative department of public health, disease prevention and control institutions and medical institutions and experts attending, and summarize the experts to form a "method" (draft). November 7, 2013, food department, respectively, and the medical administration hospital authority, CDC bureau multiple communication and negotiation, sign form "method" (draft). 
 
        Five, the main content 
 
        "Method" (draft) on the basis of administrative rules text template preparation. Full text of a total of eight chapters, 34, including general rules, cases and event information reporting, monitoring, information bulletin and early warning, information management, medical treatment, supervision and management, and bylaws. Main contents that are as follows: 
 
        (a) report of foodborne disease.         (4) information about foodborne disease management. Chapter v of this law by the national health commission is responsible for the planning and building the national foodborne disease surveillance and reporting network, as a collection, summary and analysis, the main methods of foodborne disease information storage, and infectious diseases, public health emergency reporting system and the local regional public health information platform connectivity; Require local family planning administrative department of public health at all levels to establish and apply local foodborne disease traceability platform, timely analyze the local foodborne disease information management; Put forward to build information sharing platform of working mechanism, establishing the information each other requirements.
